If the software product purchased is an academic edition, YOU ACKNOWLEDGE THAT the license is limited to use in an educational context, either for self-education or for use in a registered educational institution. Academic publishing may not be used for the manufacture of commercial software products or in a commercial environment without the express written permission of SPARX. DOORS can count on it to meet the long-term needs of the user community. DOORS is still used by many users and can be approved for as long as necessary. Although the IBM Engineering Requirements Management – DOORS family allows a company to choose between DOORS Next and DOORS in its environment with the same license right, it is not necessary for customers to switch between environments. IMPORTANT – READ CAREFULLY: This End User License Agreement (“EULA”) is a legal agreement between YOU as Licensee and SPARX SYSTEMS (“SPARX”) for the above SOFTWARE PRODUCT. By installing, copying or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If YOU do not agree to the terms of this EULA, immediately delete the unused SOFTWARE PRODUCT. GOVERNING LAW This Agreement shall be construed in accordance with the laws of the Commonwealth of AUSTRALIA in the State of Victoria.
TRADEMARKS All product and company names used in this EULA, the SOFTWARE PRODUCT or accompanying documentation may be trademarks of their respective owners. Your use in this EULA must comply with applicable policies and licenses. Windows, Windows 98, Windows NT, Windows ME, Windows XP, Windows 2000, Windows 2003 Server, and Windows Vista are trademarks of Microsoft. SPARX may extend the evaluation period upon request and at its sole discretion. If YOU decide to use this software after the 30-day trial period, a license must be purchased. After paying the license fee, YOU will receive details on where you can download the registered edition of the software product and receive an appropriate software “key” by email. EVALUATION LICENSE The trial version of the software product is not free software. Subject to the terms of this Agreement, YOU are hereby authorized to use this Software free of charge for evaluation purposes for a period of thirty (30) days. After thirty (30) days, the Software Product must be removed from the computer. Unregistered use of the Software Product after the 30-day evaluation period violates Australian, U.S. and international copyright laws.
ASSIGNMENT YOU may assign all of your rights and obligations under this EULA to another party only if YOU provide the purchaser with a copy of this EULA and all other documents, including proof of ownership. Your license will then be terminated. EXCLUSIONS To the fullest extent permitted by law, SPARX excludes for itself and for any software provider incorporated in the SOFTWARE PRODUCT all claims, expenses, losses, damages and costs directly or indirectly, incurred by or affected by you (including, but not limited to, lost costs, profits and data), resulting from: YOUR use or misuse of the SOFTWARE PRODUCT; YOUR inability to use or access the SOFTWARE PRODUCT; negligence on the part of SPARX or its employees, subcontractors or agents, or any software provider incorporated in the SOFTWARE PRODUCT, in connection with the performance of SPARX`s obligations under this EULA; or termination of this EULA by either party for any reason. Subject to the terms of this EULA, YOU have a non-exclusive right to use the SOFTWARE PRODUCT for the duration of the EULA. YOU do not acquire ownership of any copyright or other intellectual property right in any part of the SOFTWARE PRODUCT under this EULA. Your use of this software signifies your acceptance of this EULA and warranty. Users can now securely change their own passwords without the need for an administrator. Password reset is not available to organizations that use their own LDAP environment. A user can request that a password reset token be sent to their configured email account and that their password be reset. LICENSE GRANT Pursuant to the terms of this EULA, YOU have the following rights: The IBM Rational DOORS family will be renamed IBM Engineering Requirements Management – DOORS family in accordance with other IBM Engineering Lifecycle Management products. Customers with active maintenance or a subscription to the listed products can receive the appropriate media package. “SPARX Support Technician” means SPARX employees who provide online support services. SPARX WARRANTIES AND GUARANTEES OF LIABILITY warrants that the SOFTWARE PRODUCT will essentially operate in accordance with the accompanying written materials for a period of ninety (90) days from the date of receipt, and that all support services provided by SPARX must be substantially as described in the applicable written materials provided to you by SPARX, and SPARX support engineers will use commercially reasonable efforts to resolve any issues related to the SOFTWARE PRODUCT. ELM allows data to be placed under configuration management (opt-in) so that users can create parallel versions of the same technical artifacts. DOORS provides users with the ability to have an up-to-date version of the requirements and static baselines to remember the hours of this instance of a module. DOORS V9.7 allows you to link opt-in engineering data to different versions of DOORS data, either the current version or a baseline. For example, a test management user (formerly RQM) can associate a version of a test case with a specific version of a requirement, even if that request is part of a fixed baseline.
